INTERFUSION Inc. (hereinafter called the 'Company') states the term and conditions throughout JapanBrandOnline.com (Company manages the online site, hereinafter called 'JBO') what users of JBO may expect from JBO and what JBO may expect from users. By visiting any area on JBO or making a purchase via JBO, User is deemed to have accepted this Terms of Use.
Article 1 (Consent and Modification)
- This Terms of Use applies between Users and Company regarding the service of JBO that Company provides and User accepts and utilizes.
- Company deems User accepts Terms of Use when User utilizes JBO.
- Company reserves the right to modify Terms of Use at anytime without User's consent. Company will notify any modifications by posting on JBO site and deems User accept When User utilizes JBO.
Article 2 (Utilization)
- User shall utilize JBO in accordance with Terms of Use and other User Guidance that Company states on JBO site.
- Company may modify the contents of this service without prior User's consent.
Article 3 (Age of Users)
- Company does not intend JBO to be used by individuals under the age of 18(a 'Minor').Minor can use JBO only under the supervision of a parent or guardian's consent.
- Company does not allow Minor to purchase any goods with an age restriction.
Article 4 (Restriction and default)
Company may restrict the access of the service or erase the User's registration, without User・s consent when User applies the following:
- if Company acknowledges User breached any provision of Terms of Use
- if User delays or defaults in payment relating to the service of JBO
- if User performs any of the following events stated in Article 5
- if User performs any events that violates Terms of Use
Article 5 (Prohibition)
User shall not perform the following events:
- if User interferes with the operation of JBO or performs the conduct relating to the interference of the operation of service
- if User use JBO with the illegal exploitation of credit card
- if User violates the third party's interest or Company notice the possibility of such conduct
- if User violates third party's trademark, copyrights, privacy, and other related rights or Company notice the possibility of such violation
- if User performs any acts against public order and standards of decency or Company notice the possibility of such conduct
- if User performs any criminal act or the performance related to or fear of such conducts
- if User applies and registers by third party's e-mail address
- if User performs any business activities or related activities to earn his/her own profit through JBO
- if User acts against Company or third party's credit and faith
- if User exploits or provides any harmful programs such as computer virus or the exploitation of any related such conduct
- other User's conduct Company deems inappropriate
Article 6 (Reviews, Comments, Communication and other Contents)
- User may post reviews, send e-mails, submit suggestions, ideas, comments, questions or other contents so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam."
- User may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a credit card or other content. Company reserves the right to remove or edit such content, but does not regularly review posted content.
- Company has the right but not the obligation to monitor and edit or remove any activity or content. Company takes no responsibility and assumes no liability for any content posted by you or any third party.
Article 7 (Copyrights)
- User shall not exploit any information or content without express copyright owners' consent beyond the private or fair use authorized by Japanese or international copyright laws.
- In the event of any claim of infringement, User, at their own responsibility and expense, shall solve the problem and protect Company from any harm and/or damage.
Article 8 (Purchase)
- User may utilize JBO and purchase the goods from the service.
- User applies for the purchase of the goods in accordance with method that Company provide.
- For the application of the purchase of the goods, Company sends the e-mail 'JapanBrandOnline.com confirmation of the purchase' to User. The agreement will be made between User and Company the time Company sends the confirmation e-mail to User. Company may not allow User to the cancellation after User has ordered.
Article 9 (Termination)
- Company may terminate the sales agreement Company and User has reached, as 3 clause of Article 8, without prior consent in the event that:
- If User defaults or material breach of Terms of Use
- If credit-card company notices Company of User's default
- If Company acknowledges User may fail to the payment
- If Company cannot deliver the goods because of incorrect address or long leave of absence of User
- Regardless of the statement above, Company may cancel, terminate or process the appropriate step, in the event Company acknowledges any harmful conduct or inappropriate act anytime.
Article 10 (Payment)
- User shall pay for the goods in accordance with the methods shared by Company and choose one of them in the purchase application.
- If User chooses to pay by credit card, User shall agree the condition provided by the credit card company. In the event that the dispute arises between User and credit card company, Company shall have no responsibility and User shall protect Company from any harm.
Article 11 (Delivery)
- User may receive the goods in one week to one month from order date except winter holidays, golden week (the first week of May), summer holidays or any other Company's authorized holidays. Company is not liable for the delivery date.
- Company is not liable for the same delivery date when User orders more than two kinds of goods at the same time.
- Company reserves the undelivered rights for countries that have no diplomatic relations with Japan and delivery company cannot track and for the nature of goods.
Article 12 (Return Policy)
- User may return the goods after the delivery in accordance with the following procedure:
- Within three (3) business days, User shall return the goods with the return application. Company shall accept the return when Company receives the goods.
- User shall ship the goods with the same insurance coverage and User shall endure the shipping and insurance cost. After the return goods have been delivered, if any damage, deficiency of quantity and any other loss that may be found by the inspection of the goods, Company shall compensate from User's payment.
- Company shall begin the return procedure immediately after receiving returned goods at the responsible section. User shall refer the return rate at the User Guidance. User shall endure seven to fourteen business days to receive the payment depending on the condition of the return acceptance section. If User uses the credit card, the process may take more time depending on the credit company's procedure. Company shall not benefit from any profit for JBO's liability regarding the compensation.
- User may return the damaged goods in accordance with the following:
- if User assume the physical damage at the delivery, User may report to the carrier, receive the accident report and apply for the return process to JBO.
- after confirming the acceptance of the accident report issued from the carrier, Company may send the alternative goods and endure the delivery cost. If there are no alternative goods, Company notifies the fact to User through e-mail and returns the payment in accordance with the process above.
- Title and risks of loss to the goods shall pass from Company to User when Company delivers the good to the carrier.
Article 13 (Security)
- Company shall use the security measure to prevent User's private information from being intercepted and read from outsider.
- Company uses the standard e-commerce security technology called Secure Sockets Layer (SSL) encryption technology over the Internet. SSL encrypts the data and prevent it from being read by someone pretending to be User.
- Company secures the e-mail message sending to User with minute attention. However, if a hacker sends e-mail containing a virus pretending to be sent from Company, User shall not open such a suspicious e-mail. If User receives such e-mail, User may let Company know.
Article 14 (Suspension of Service)
- Company may suspend all or part of the JBO's service to maintain the good operation without User's prior consent in the event of the following:
- if Company needs regular or emergence maintenance of the system
- if fire, blackout or the third party's interruption prevents the operation of service
- if Company judge the suspension of service , is necessary, because of any other reasons.
- Company is not liable for User's damage and loss in accordance with suspension of service stated above.
Article 15 (Other Indemnifications of Responsibility)
- If Company is obliged to notify User about any information, Company exempts any obligation after sending the message to the address or e-mail address that User registered. If Company delivers the goods User ordered, Company exempts any obligation after delivering it to the address that User stated at the order.
- Company is not liable for any damage or problems causing delay or impossibility of delivery by carries beyond reasonable control, including earthquake, natural disaster, government action, riot or civil commotion and labor disputes.
- Company disclaims the liability for any damages, loss or inconvenience for User by trading the goods through JBO beyond Terms of Use even if the law states it\’s a legally acceptable request.
- Company is not liable for any damages caused by User not utilizing JBO\’s service.
- Company disclaims the liability when failing to identify User in accordance with the method Company stated after User changes his/her password.
- User is liable for the disputes with other third party arising from User’s utilization of the service with its own responsibility and expenses and Company is not responsible in regard to these disputes.
- Company disclaims the warranty of completion, accuracy or security for the information sent to User because it may include information Company has received from User, such as personal subjective estimation, out of date information and hearsay.
Article 16 (General Provisions)
- In the event of User・s default of the payment or other breaches of this Term of Use and Company hires an attorney for seeking injunctive relief or the remedy of this damage, User shall endure the attorney's cost.
- JBO has some pages using the 'cookies (small files or records that Company place on User's computer's hard drive to collect information about your activities on JBO)' to enhance the browsing and shopping experience on JBO, User agrees to Company use of cookies. Company sets JBO depending whether User accept or reject to use this technology and User may prohibit it at anytime at their own responsibility. User agrees Company may not provide some services in the event that User prohibits the use of Cookie.
Article 17 (Governing Law and Venue)
This Terms of Use is governed by the law of Japan, without regard to its conflict of laws principles. Any legal actions (including judicial and administrative proceedings) with respect to any matter arising under or growing out of this Terms of Use, shall be brought in the Tokyo District Court, Japan.
This Terms of Use shall be prepared in Japan and translated in English, German, French, and Spanish, but in the event of any difference or inconsistency between the versions of this Terms of Use, the Japanese version shall prevail in all respects.
